　　知识产权法院，是在《中共中央关于全面深化改革若干重大问题的决定》中所提出的准备探索建立的审判机构，其原文内容是"加强知识产权运用和保护，健全技术创新激励机制，探索建立知识产权法院。" 2014年8月31日，十二届全国人大常委会第十次会议表决通过了全国人大常委会关于在上海设立知识产权法院的决定。上海知识产权法院于2014年12月28日揭牌成立，自2015年1月1日起履行法定职责。
